2. Designated Age

Our Shop is not intended for individuals under the age of 18 years old “Designated Age”. No one under the Designated Age may provide any personal information to or on our Shop. 

We do not knowingly collect personal information from children under the Designated Age. If you are under the Designated Age, do not use or provide any information on our Shop, or through any of its features, register on the Shop, make any purchases through the Shop, use any of the interactive or public comment features of our Shop, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. 

If we learn we have collected or received personal information from a person under the Designated Age without verification of parental consent, we will delete that information. a. Information You Provide to Us

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Shop, or transmitted to other users of the Shop or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Shop with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

b. Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Shop, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.
  3. Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target audience preferences, you can opt-out. For this opt-out to function, you must have your browser set to accept all browser cookies.

8. Accessing and Correcting Your Information

You can review and change your personal information by logging into the Shop and visiting your account profile page.

You may also send us an email at hi@goosechase.com or at https://www.goosechase.com/contact to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Shop, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Shop users. Proper access and use of information provided on the Shop, including User Contributions, is governed by our terms of use.

9. Your Data Protection Rights Under General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Goosechase aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

In certain circumstances, where we act as Data Controller, you have the following data protection rights:

  1. Request access to your Personal Information (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Information we hold about you where we are the data controller and to check that we are lawfully processing it;
  2. Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected, though we may need to verify the accuracy of the new information you provide to us;
  3. Request erasure of your Personal Information. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request;
  4. Object to processing of your Personal Information where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal information for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms;
  5. Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios: 
    1. if you want us to establish the information's accuracy; 
    2. where our use of the information is unlawful but you do not want us to erase it; 
    3. where you need us to hold the information even if we no longer require it as you need it to establish, exercise or defend legal claims; or
    4. you have objected to our use of your information but we need to verify whether we have overriding legitimate grounds to use it

  6. Request the transfer of your Personal Information to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you
  7. Withdraw consent at any time where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time you withdraw your consent.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA).

If you wish to exercise any of the rights set out above, please follow any of the steps hereunder;

  2. fill out a request by following the relevant steps on this form; or
  3. delete your account, as well as all the data held on you from within the web or mobile app.

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it.

We may also contact you to ask you for further information in relation to your request to speed up our response.

10. Your California Privacy Rights (CCPA)

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information. Amongst other things, the CCPA provides Californian consumers with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

a. Right to Know and Data Portability
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. When applicable, you will be granted the right to;
  1. request access to your Personal Data that We may have collected, used, or disclosed about you;
    ii. request that We delete any Personal Data about you in a reasonable amount of time;
    iii.request to download data we have on you;
  • request that We transfer, when possible and applicable, your personal data to another recipient; and
  • receive a non-discriminatory treatment for exercising any of your data protection rights.
Upon reception of your request, and confirmation of your identity, we may disclose;
  • The categories of personal information we may have collected about you;
  • The categories of sources for the personal information we collected about you;
  • The categories of third parties with whom we share that personal information.
  • Our business or commercial purpose for collecting or selling that personal information.
  • Whether we sold or disclosed your personal information for a business purpose.
b. Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
Once we receive your request and confirm your identity, we will review your request. We may deny your deletion request if retaining the information is necessary to:
  • Complete the transaction for which we collected the personal information;
  • Protect you or someone else against, deceptive, malicious, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
  • Comply with a legal obligation;
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
    c. Exercising Your Rights to Know or Delete

    To exercise your rights to know or deletion, please follow any of the steps hereunder;

    • fill out a request by following the relevant steps on this form; or
    • delete your account, as well as all the data held on you from within the web or mobile app.
    d.Timeline
    We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at: hi@goosechase.com

    We endeavour to respond to a verified request within forty-five (45) days of its receipt. If we require more time (up to another 90 days from the initial submission request), we will inform you of such an extension, together with any reason for such extensions. Any requests may only cover the 12-month period preceding receipt of your request.

    Please note that any such requests are free, and as such, we will never charge you anything for enforcing your CCPA rights. However, if it is demonstrated that such requests were submitted excessively, repetitively, or for a purpose other than protecting your personal data, we will provide this service at a cost.

    We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

    • deny you access to our platform;
    • charge you different prices or deny you discounts; or
    • provide a different level of customer support;
    11. California Online Privacy Protection Act (CalOPPA)

    In alignment with California Online Privacy Protection Act (CalOPPA) requirements, Goosechase ensures transparency and adherence to privacy standards for all users, including those in California. Our compliance includes the following:

    Posting of Privacy Policy
    We conspicuously post our privacy policy on our Shop to inform users about the collection and usage of personally identifiable information (PII). This policy outlines the categories of PII collected, how users can review and amend their information, notifications about changes to the policy, effective date identification, and our response to "do not track" signals.
    Compliance with Privacy Policy
    Goosechase strictly adheres to the provisions outlined in our posted privacy policy. We ensure that all collected PII is handled responsibly and used only for the intended purposes of providing and improving our platform.
    Accessibility of Privacy Policy
    Our privacy policy is easily accessible through various means, including web pages or functional hyperlinks. We ensure that users can readily review our privacy practices to make informed decisions about their data.
    Do Not Track (DNT)
    While Goosechase does not currently respond to "Do Not Track" signals, we respect users' privacy preferences. Users can manage their privacy settings within their Goosechase account and control cookies and tracking at https://www.goosechase.com/cookie-policy
    12. The Texas Data Privacy and Security Act (TDPSA)

    If you are a Texas resident, you have certain data protection rights under the Texas Data Privacy and Security Act (TDPSA). Goosechase aims to facilitate the exercise of these rights to ensure the protection of your personal data.

    In certain circumstances, as specified by the TDPSA, you have the following data protection rights:

    Data Request: You have the right to request access to your personal information, allowing you to receive a copy of the data we hold about you in a structured, commonly used, machine-readable format within 45 days of receipt of the request.

    Data Correction: You can request correction of any incomplete or inaccurate personal information we hold about you, ensuring the data's accuracy.

    Data Deletion: You have the right to request the deletion or removal of your personal information where there is no legal basis for its continued processing.

    Consent Withdrawal: You can withdraw your consent to the processing of your personal information at any time. Goosechase does not sell any user data.

    Children's Data: Goosechase will refrain from intentionally processing any sensitive data of a child under age 13 in a manner that falls outside the parameters outlined by COPPA.

    Please note that we may need to verify your identity before fulfilling any requests related to your personal information. Additionally, exercising your rights under the TDPSA is free of charge.

    13. The Texas Information Disposal Act (IDA) - House Bill No. 698

    If you are a resident of Texas, you hold specific rights concerning the protection of your data under the Texas Information Disposal Act (IDA). Goosechase is committed to assisting you in exercising these rights to safeguard your personal information.

    In accordance with the IDA, you may have the following data protection rights:

    Data Deletion Practices: In line with the IDA requirements, Goosechase implements secure data disposal practices to safeguard sensitive information. When data is no longer needed for its intended purpose or upon request for deletion by users, Goosechase ensures that the data is securely disposed of to prevent unauthorized access or disclosure.

    Data Deletion Procedures: Upon user request or at the end of the data retention period, Goosechase employs secure deletion procedures to permanently remove sensitive information from its systems. This includes erasing data from databases, servers, and any other storage devices in a manner that ensures irretrievable deletion.

    Data Retention Policies: Goosechase maintains clear data retention policies that align with the provisions of the IDA. We only retain data for as long as necessary, or until a deletion request is made, to fulfill the purposes for which it was collected or as required by law.

    14. Data Security

    We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers. Any payment transactions will be encrypted using SSL technology.

    The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Shop, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Shop like message boards. The information you share in public areas may be viewed by any user of the Shop.

    Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Shop. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Shop.

    15. Notification of Data Breaches

    Goosechase commits to promptly notifying any of our affected users in the event of a data breach. We will notify affected users of a data breach within 2 days. The notification will contain details of:

    1. the breach, 
    2. the type of information involved, and 
    3. steps that can be taken to protect yourself. 
    16. Retention & Deletion
    Retention
    We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, Non-personal Information, Account recovery, or if otherwise required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy.
    We share your Personal Information within our company and with third-party service providers. This will involve, if you are based in the European Union, transferring your data outside the European Economic Area (EEA).
    Many of our external third parties are also based outside the European Economic Area (EEA) so their processing of your Personal Information will involve a transfer of data outside the EEA.
    If you are based in the European Union, whenever we transfer your Personal Information out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
    • Where the country has been deemed to provide an adequate level of protection for Personal Information by the European Commission.
    • Where we use certain service providers, we may use specific contracts approved by the European Commission which give Personal Information the same protection it has in Europe.
    • Where we use providers based in the U.S., we may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to Personal Information shared between Europe and the U.S.
    Deletion
    You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
    • Complete the transaction for which we collected the personal information;
    • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; or
    • Comply with a legal obligation;

    • delete your account, as well as all the data held on you from our Shop.
    Your data deletion request will be responded to within 10 days of reception, and if eligible, deleted within 28 days.
    17. Changes to Our Privacy Policy

    We reserve the right to change this Privacy Policy at any time. If We decide to change this Privacy Policy in the future, We will post an appropriate notice on our webpage at. Any changes will become effective 30 days from their posting on the Shop, App or Service. The date on which the latest update was made is indicated at the bottom of this document. Your continued use of the Shop, App and/or Service signifies your acceptance of any changes.
